At the recent eVisa conference held in Beijing, we took many questions from you – more than we were able to respond to on the spot – and promised to come back with a consolidated response that addresses your concerns. Here is the list of questions and answers by category. In addition to the questions you asked at the conference, we have also included a few other frequently asked questions received from you in the past, which we thought would be useful to post here.

General Student Policy

1.If the sponsor’s details change after the applicant’s visa has been granted do they need to inform DIMA? If so how?

If the individual providing funds to the student has a change in circumstances that means there will no longer be funds available to support the student, they should notify the local DIMA office in the state in which the student is studying.

2.If the student has completed a graduate certificate programme of more than 10 months duration in Australia can they apply for another student visa in Australia or does he have to return home to apply?

Student visa holders who are studying for more than 10 months in Australia generally won’t have visa condition 8534 (no further stay) applied to their visa. Student visa holders who do not have condition 8534 attached to their visa will be able to apply for a further student visa onshore.

3.Can an applicant bring their spouse to Australia if the duration of the package of courses is more than one year or only their principle course is more than one year?

A dependent spouse can apply to travel to Australia with a student visa applicant as long as the intended course, or package of courses, is more than one year in duration.

4.If an applicant wants to change their career or study direction will he have to submit a study plan to DIMA to explain the change? (eg. if someone holds a Bachelor in Engineering and want to undertake a diploma in Cookery)

No. DIMA no longer requires AL4 applicants for a student visa to submit a study plan to explain the relevance of their proposed course to their career.

5.If an applicant’s parents have previously been refused a visa for Australia, will this affect the outcome an application for a student visa?

Each student visa application will be assessed on its merits. Applicants should provide full information in respect to their or their family’s previous immigration history. Previous refusals may be considered in assessing an application where it is considered relevant to the genuineness of the applicant.

6.If the student’s contact details change after one year has passed since visa grant does the student have to inform the agent or DIMA?

All student visas are subject to condition 8533 which requires the student to notify their education provider within 7 days of their contact details changing. As a matter of good practice, students should also notify their education agent when their details change.

Financial Capacity

7.What are the financial capacity requirements for dependents on a student visa?

AL4 applicants for a student visa must demonstrate that they have adequate funds to meet their course fees, living and travel costs for them and their dependents, as well as school fees for any school-age dependents. Adequate funds from an acceptable source must be demonstrated to meet these requirements for the first 36 months of the applicant’s stay in Australia. These requirements must be met regardless of whether the dependents are travelling to Australia with the applicant, or if they are staying behind in their home country.

Living costs for the primary applicant and dependents are set as follows:

Primary applicant:                $12,000AUD per year
Spouse or de facto dependent:          $4,200AUD per year
First child dependent:              $2,400AUD per year
Any further child dependents:          $1,200AUD per year

School fees for school age dependents are set at $8,000 per year.

8.Do student visa holders have to pay fees for their child dependents to attend school in Australia?

Yes. Student visa holders will be required to pay school fees for their school-age dependents except where the school may decide to waive the fees.

9.Can the loan be terminated within the first 36 months of the students studying in Australia (wholly or partly)?

No. If a student has provided evidence of funds in the form of a student loan, that loan must be available to the student for the first 36 months of their stay in Australia.

10.If the parents of a student visa holder gain enough money from their income to pay off the student’s loan that was used for the grant of the visa, is it acceptable for them to pay off the loan?

No. If a student chooses to demonstrate their financial capacity through a loan, the loan is expected to be taken out solely for the support of the student’s stay in Australia. The loan should therefore continue to be available to the student for the first three years of their study in Australia.
